Default Legal implications

Some time ago it was reported that a 61 year old man up in Queensland was arrested for uploading a video to a site which showed a baby getting swung around by its legs. The guy wasn't in the video and didn't take the video, he simply reposted the video on his own site.

He was arrested by Queensland Police and now faces up to 10 years in prison as it's a crime "to participate in the exploitation and abuse of children by seeking to view, possess, make or distribute child-abuse or child exploitation material".

Today it's hit the news site again as the lawyer is warning people who own and even surf web sites as these laws can also effect you.

Apparently the baby is seen to be laughing at the end of the video however "experts" claim that it's possible that there is a hidden injury and therefore it's considered child-abuse.

I find this to be totally unbelievable.

I appreciate what the law is trying to do however in this instance it's totally inappropriate.

In this case are they expecting this 61 year old man from Queensland to know whether the child sustained "hidden injuries" or not and therefore determine whether it is "child abuse". This is pretty crazy stuff.

This story has implications for all webmasters who allow the submission of content, which would include anyone who owns a blog, forum, etc. As the site owner you are responsible for the content on your site and its quite disturbing the situation you could end up in.

What would you do if someone uploaded this (which most people consider as "humorous") video to your site? Would you allow it?
